WITNESS STATEMENT
(CJ Act 1967, s.9; MC Act 1980, ss.5A(3)(a) and 5B; MC Rules 1981, r.70)

Statement of James COTTAM
Age if under 18: OVER 18 (If over 18 insert 'over 18')
Occupation: FLOOR LAYER

This statement (consisting of 1 pages each signed by me) is true to the best of my knowledge and belief and I make it knowing that, If it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated anything in it, which I know to be falsa or do not believe to be true.

Further to my statement dated 01/05/05. After many conversations with Police regarding Bernard O'MAHONEY and Adrian FOSTER I have decided to retract my earlier statement.

My reasons for doing this is because of the pressure both myself and my partner Kirsty JONES are under with the build up to the court date. The statement I gave on 01/05/05 I signed as being true.

This is correct and I have not lied to the Police or anyone else regarding this matter. Since the day of O'MAHONEYS incarceration on 03/05/05 myself and Kirsty have received numerous appeals from third parties for his release.

This is ongoing and has caused me anxiety and stress which escalates with each week this matter drags on. The appeals have been by telephone, by letter and in person. No direct threats have been made however I do not wish to name the person(s) responsible as I wish to avoid repercussions of any kind.

On 16th June 2005 myself and Kirsty signed a letter to Police which we had jointly composed. This was done in the presence of George POLLARD solicitor in civil law, solicitor for Double and Megson. I exhibit this as my exhibit JC/L1.

On Monday 13/06/05 I received an anonymous letter which I refer to as JC/L2. Whilst I have no evidence to link this letter to the case I am not in dispute with any other person and have no idea who it is from. I wish this matter to be brought to an end and the case to be discontinued.

I do not wish to attend court to give evidence as this would cause me further stress.
