Dear Mr. O'Mahoney,
SHAUN ANTHONY ARMSTRONG
I refer to our previous telephone call, and your letters
in connection with the above.
I have discussed this matter at length with a number of
officers who had some involvement in the prosecution of
Armstrong.
I have also been in touch with the Crown Prosecution Service.
They have confirmed that the letters addressed to Laurna
Stephens were classified as unused material insofar as
the criminal trial was concerned.
I also understand from some memos that were written at
the time of the trial that the originals of these letters
were retained by the News of the World, and copies only
were sent to the police.
In those circumstances, and having considered very carefully
your request in relation to the litigation in which you
are now involved, the police are not prepared to voluntarily
provide you with copies of the correspondence in their
possession.
I would respectfully suggest that you approach either
the News of the World and obtain copies from them, or
issue an application to the Judge who is dealing with
your present litigation seeking an order that the police
disclose these letters to you.
Clearly, if a Judge were to order disclosure to you then
the police would comply with such an Order.
I realise that the police stance will be something of
a disappointment to you, but I am sure that given the
sensitive nature of this matter, and the unusual circumstances
of it, you will understand the position taken by the police.
If there is anything further with which I can assist,
please do not hesitate to contact me. Yours sincerely,
G.F. Tompkinson Solicitor - Legal Services |
