Statement of Rebecca Jackson PC1425
Age if over 18: Over 18
Occupation: Police Officer
This statement consisting of six pages, each signed by
me, is true to the best of my knowledge and belief and
I make it knowing that if it is tendered in evidence I
shall be liable to prosecution if I have wilfully stated
in it, anything which I know to be false or do not believe
to be true.

I am Police Constable 1425 Rebecca JACKSON of Cambridgeshire
Constabulary currently based at St Ives Police Station.
On Saturday 7th December 2002 at around 02.20hours I was
on duty in full uniform as part of a Police Support Unit
- VBO4C. At this time we attended The Bull Hotel, Westgate,
Peterborough.
A report had been received that disturbance was taking
place outside this location. On arrival there were already
other police officers at the scene. I got out the van
and walked on to the nearest pavement - this was immediately
outside the Bull Hotel.
My attention was instantly drawn to a man I now know to
be Patrick Bernard O'Mahoney. O'Mahoney was shouting abuse
at everyone at the scene saying "its that fucking
wanker you want".
O'Mahoney was pointing to a male on the other side of
the street. I could see that there were officers with
this particular male so I remained on the same side as
O'Mahoney. Inspector TAYLOR was trying to talk to O'MAHONEY
but he was not listening.
O'MAHONEY was pacing along the pavement, waving his arms.
He continued to swear saying " that fucking cunt
has pushed my wife, what are the fuckers doing about it.
You're nothing but fucking scum". At this particular
time in the morning members of the public are emerging
from clubs.
There were members of the public passing by during the
incident and O'MAHONEY was drawing attention to himself,
I myself felt offended by his language. When I first arrived
at the scene I warned O'MAHONEY regarding his language.
I said to him " I don't appreciate your language,
if you continue to swear you will be arrested under section
5 of the Public Order Act. O'MAHONEY continued to behave
in a disorderly behaviour; he kept saying, "fuck
off the lot of you". I again warned him about his
language at 02.28hours.
He replied, "Fuck off smarmy cunt". At 02.30hours
I said to O'MAHONEY " I am arresting you under section
5 of the Public Order Act". I cautioned him to which
he replied, "Fuck off". Due to O'MAHONEY'S demeanour
I placed in handcuffs in the rear stock position.
O'MAHONEY is a large, heavy built man with a height of
approximately 6'. I am 5'9" and of much smaller build
that O'MAHONEY. I felt I needed to place him in cuffs
because I would not have been able to restrain him had
he been disruptive without cuffs on.
Although quite well lit, the time of day meant it was
dark outside; the weather was cold and damp making it
slippery. As our van did not have prisoner transportation
capability a van from divisional mobiles was requested.
To avoid O'MAHONEY getting wet - it was raining and also
to avoid any unnecessary embarrassment to him, myself
and another officer placed him in the side section of
our van to await transportation. It wasn't long before
the van arrived at the scene and I said to O'MAHONEY "
are you going to jump out now and get in the other van
please".
He replied " Fuck off, ask me nicely". I again
said, "Please get out the van". O'MAHONEY still
refused to get out. He placed his left foot on the door
pillar of the van and his right foot on a ledge behind
the front seats. He then said "If you want me out,
you're going to have to fucking get me out you wankers".
I was aware of another officer present although I don't
know who this was. PC TINNION was in the driver's seat
of the van and came to assist when he realised the problems
I was encountering. I tried to pull O'MAHONEY from the
van but his feet were wedging him in.
I had to physically climb into the van with O'MAHONEY.
It was at this time I felt very vulnerable - in an enclosed
space dark space with a male who had potential to act
in a violent manner. When I managed to get in the van
I was still unable to move O'MAHONEY - he is a very heavy
stocky man.
He was still sat on the seat with his feet wedged on the
sides. I was unable to move his legs to get him out of
the van using my hands. The only I was able to move his
leg was by kicking his calf muscle with the front of my
shin.
Only one strike was required to move his leg. He then
got out of the van and walked the short distance across
the road to the awaiting divisional van. The back doors
to the van were open ready to receive O'MAHONEY. As I
approached the van with him he said "I ain't getting
in there, you can't do this to me."
There were a number of other officers present trying to
assist me in getting O'MAHONEY in the van. As he refused
to get in he leant towards me, placing most of his body
weight on me. I found it extremely difficult to hold him
and stay upright. O'MAHONEY persisted in shouting, "fuck
off you cunts".
His language was clearly audible and very offensive. The
other officers present had to physically push him in to
the back of the van. It was impossible for him to be placed
in the van as he still struggled. He stood upright after
his body had fallen in the cage.
He then, after saying "get the fuck off me and I'll
get in", stepped in to the cage of the van. As I
closed the door behind me he shouted, "you're nothing
but scum you cunt". O'MAHONEY was subsequently conveyed
to Thorpewood Police Station arriving at 02.40hours.
The circumstances surrounding his arrest were relayed
to the Custody Sergeant PS 497 GRAHAM who authorised his
detention (custody reference number 35TW6644/02). Throughout
the booking in procedure O'MAHONEY continued to be abusive
and wouldn't listen to the Custody Sergeant.
On more than one occasion he was told he would be placed
in his cell prior to his rights. He eventually stayed
quiet enough to receive his rights. He did, however, refuse
to sign his Custody Record. He was subsequently taken
to his cell where he refused to remove his shoes.
Approximately four officers had to enter the cell and
state they would have to remove his shoes. O'MAHONEY refused
to remove his shoes and said, "You'll have to fucking
do it". He was told by an officer that his shoes
would be removed and if he resisted or fought back then
he would be restrained.
His shoes were eventually removed without event. As the
cell door was being closed O'MAHONEY looked at me, pointed
and shouted "and she's a fucking cunt, she knows
I haven't done anything wrong". The door was closed
and I am making this statement immediately thereafter.
The time of completing this statement is 04.20hours on
Saturday 7th December 2002. The incident from my arrival
at the scene to O'MAHONEY being booked in to custody was
approximately 30 minutes. The distance between myself
and O'MAHONEY was within arms length.
Visibility was adequate. Although during the hours of
darkness there was sufficient sheet lighting present.
Albeit raining lightly this did not distort visibility.
O'MAHONEY was not known to me prior to this incident.
I would, however, recognize him again.
