Caution given - explained and understood.
O'MAHONEY is to be questioned re an allegation made against him by Kirsty JONES of Threats to Kill. He is also alleged to have threatened Kirsty's partner James COTTAM. O'MAHONEY will say that Kirsty has nothing to do with anything and the only person involved is James COTTAM. O'MAHONEY is asked for his version of events.
O'MAHONEY commenced with detailing the background history between himself, COTTAM and Adrian FOSTER - he will say COTTAM and FOSTER were doing some work at his house for him during which time COTTAM ran off with FOSTER'S girlfriend. O'MAHONEY elaborated on this background history at length, claiming there is a dispute over the unfinished work on his house. DC GURNEY asked O'MAHONEY to account for his movements over the weekend with his nieces - he will say he was in Paris having left home on Friday morning and not returning home until Sunday night (about 9 or 10pm). He claims he stayed in the rest of the evening.
He spoke further about the dispute between himself and COTTAM over the unfinished work. He will say because FOSTER and COTTAM had fallen out, neither wanted to carry out the work of finishing off.

To the best of your recollection then tell me what, how the conversation went

I shouldn't be ringing him up having a go at him and I just said to her it's nothing to do with you, just do the work as you promised and you'll never hear from me again, that's the end of it, just do it... I don't even want to talk to you about it, it's none of her business do you know what I mean.........
This conversation took place on the Sunday - there were numerous calls between all three of them. O'MAHONEY does not know what Kirsty's telephone number is because she rang him and he didn't save her number, simply because she'd got nothing to do with the matter. O'MAHONEY has COTTAM's number stored on his phone under 'James the floor' and FOSTER as 'Adrian Deeping'. His own number is 07919151295 - Vodafone network, contract phone registered in his own name.
DC GURNEY reminded O'MAHONEY of the reasons for his arrest - he cannot think specifically what he may have said to any of the persons involved which may have been perceived as a threat. He claims he may have said words to the effect of "Just do the fucking work else I'll come round and get you" - this would have been said as a 'heat of the moment1 thing.
O'MAHONEY reiterated when he arrived back at his home address from Paris he stayed in for the rest of the night and did not have any contact with Kirsty, COTTAM or FOSTER. O'MAHONEY claims all he wanted was his floor finishing - nothing more. No one else has access to O'MAHONEY's mobile phone - he confirms he took it to Paris with him at the weekend. The dispute over the flooring was discussed further.

DC GURNEY refers to a statement provided by James COTTAM and read extracts from it outlining the allegations he makes. The background history between himself, COTTAM and FOSTER was also briefly discussed.
O'MAHONEY made reference to the fact he is aware that whilst FOSTER was out for the day with his son, Kirsty and James and gone to the house and removed all items of property. DC GURNEY continued reading from the statement. O'MAHONEY agrees he sent James a text to the effect of "Kirsty states it's hers, you owe me a grand plus interest, coming to pick it up now, you get her to ring and disagree, foolish"

Okay he says then he gets another text message at 9.31 that morning "You're taking the piss boy, you fuck off with his woman then steal his gear, you're playing a dangerous game son, you need to ring me as soon as possible to stop things accelerating, prick, as soon as possible". Did you sent that one?

Well obviously yeah O'MAHONEY claims this is all one sided, he wishes to point out that he has been threatened himself by the other parties - he does not feel he can answer any more questions at present. O'MAHONEY will say he's done nothing wrong, all he wants is money that's owed to him from the unfinished work.
