Statement of: JAMES COTTAM

This statement (consisting of 6 pages each signed by me) is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated anything in it, which I know to be false or do not believe to be true.

My girlfriend, Kirsty Helen JONES and I have been together since January 2005. Her ex boyfriend
is an Adrian FOSTER who is an associate of a Bernie O'MAHONEY.
I know O'MAHONEY as I did a job for him at his house in Market Deeping
where I layed a floor for him at a cost of £1200, which he has refused to pay me.
I have recently
been getting texts from O'MAHONEY from mobile phone number 07919151295, as follows;
28 Apr 05 1001 pm: "NOT HAPPY RE ADRIAN'S STUFF YOU NICKED, YOU RANG THE
POLICE WHEN YOU WERE IN THE WRONG. I'M GOING AWAY TONIGHT. I WILL BE BACK MONDAY.
HAVE ADRIAN'S STUFF BACK BY THEN. THIS IS GETTING SILLY. TRUST ME - BERNIE"
29 Apr 05 9.26a.m: "KIRSTY SAYS ITS HERS YOU OWE ME A GRAND PLUS INTEREST.
COMING TO PICK IT UP NOW
YOU GET HER TO RING AND DISAGREE - FOOLISH"
09.31 am "YOUR TAKING THE PISS BOY YOU FUCK OFF WITH HIS WOMAN THEN STEAL
HIS GEAR. YOU'RE PLAYING A DANGEROUS GAME SON. YOU NEED TO RING ME ASAP TO
STOP THINGS EXCELLERATING - PRICK - ASAP"
09.41 "TOLD YOU TO RING. FUCK YOU NOW. YOU OWE ME A GRAND WITH £500 A
DAY INTEREST. BE CAREFUL WHEN PEOPLE RING YOU TO PRICE JOBS - YOU WONT LIKE WHO YOU MEET WHEN YOU GET THERE. YOU'RE INCAPABLE OF DOING THINGS
EASY AREN'T YOU - PRICK"
09.54 am "YOU WANKER RING THE POLICE ABOUT ME YOU SAID - YOU'RE HISTORY
PRICK - THEN YOU'RE MATE ISN'T YOUR MATE"
6.23 pm "TAKE ME ON FOOL. I WILL NOW RUIN YOUR BUSINESS AND YOUR LIFE IN
BOURNE. I ASKED YOU TO GIVE MY FRIEND HIS STUFF BACK, YOU REFUSED AND NOW
YOU HAVE A HUGE PROBLEM"
6.25 pm "I DARE YOU TO GRASS ON ME, MY MAN IS ON HIS WAY TO TEACH YOU
ABOUT FUCKING WITH ME"
Soon after this he rang me on my mobile phone. I knew it was O'MAHONEY and I did not answer,
Kirsty did. I rang him back on 07919 151295. I said "what do you want me to do"
He said "hang on ring me back in a minute and I will let you know"
I rang back and O'MAHONEY said "I WANT THE SOFA, TELEVISION, WASHING MACHINE,
TUMBLE DRYER, THEN PICK A NUMBER BETWEEN ONE AND TEN"
I said "five"
He said "put 500 QUID THROUGH MY LETTER BOX BEFORE I GET BACK THEN IT WILL BE
OVER"
I agreed to this and the conversation was over.
I texted him back and said "are you sure that's it. You've had me over for 1200 quid. I hope this is
the end of it"
I did not hear back from him.
At 6.56 pm I received another text saying "PUT ADY'S STUFF IN HIS GARAGE AND MY MONEY
THROUGH MY LETTER BOX. I'M IN PARIS UNTIL SUNDAY"
Also on 29th April 2005 in between 9.30 and 10.00 am I received a phone call from O'MAHONEY
between text messages. I could hear a lot of noise in the background. O'MAHONEY said "YOU HAVE ADY'S STUFF BACK BY THE TIME I GET BACK. YOU CLEARED HIS HOUSE AND
NICKED HIS STUFF. I'M GOING TO CUT YOU ANYWAY AND IF YOU CALL THE POLICE I WILL
SLIT YOUR THROAT"
I tried to reply and he said "STOP
FUCKING TALKING AND YOU LISTEN TO ME, YOU DO AS I SAY AND YOU WONT GET HURT"
The phone went dead.
On 30th April 2005 at 11.45pm I received another text from O'MAHONEY on the same number. I
actually read it at 09.15am on 1 May 05.
It read "DID YOU PAY WHAT YOU OWE TODAY"
At 4.51pm on 1st May 05 while at Bourne Police Station I received another text from O'MAHONEY
on the same number. It said "I'M BACK NOW YOU DIDN'T GIVE MY MATE HIS GEAR AND YOU
DIDN'T PAY ME. WHY NOT" I'M GOING TO SEE YOU TODAY. WHY AGREE AND THEN NOT
DO IT?"
At 5.03pm by my watch my phone rang and the digital display showed "BERNIE CALLING". It
happened again twice within 5 minutes.
At 5.09pm I received a text saying "YOU'RE REALLY FUCKING ME OFF - ANSWER FOOL"
At 5.11 pm he rang my number again and I answered it. He said "I'M GOING TO FUCKING KILL
YOU, I'M GOING TO FUCKING KILL YOU, WHY MAKE AN AGREEMENT AND NOT KEEP IT. I'M
COMING UP TO THE HOSPITAL NOW. I rang it off.
Soon after I received another 2 calls
From him which I ignored.
At 5.16 I received another text from saying "I'M TELLING YOU JAMES DON'T FUCK WITH ME OR
PLAY GAMES, I WANT THIS SORTING TODAY. ANSWER YOUR PHONE. I WILL SPEND
TODAY LOOKING FOR YOU. I'M NO FOOL"
I am frightened of this man and what he may do.
I am afraid to go home and am thinking about
booking into a hotel for the night. I am so frightened that I am considering moving out of the area
and leaving the country to get away from him.
While making this statement at 5.20pn he texted again saying "I'M IN LONDON AND BECAUSE
YOU WON'T ANSWER I'VE GOT TO DRIVE TO PETERBOROUGH"
He has continually been ringing my phone since that text.
I wish to make a complaint about the threats O'MAHONEY has made to kill me. I truly believe that
he is capable of doing this or arranging for it to be done.
At 5.28pm I received a call from number ****** I do not know who this is and I did not
answer it. It rang again at 5.29pm
I am willing to attend Court if necessary. |
