WITNESS STATEMENT

This statement (consisting of 8 pages each signed by me) is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated anything in it, which I know to be false or do not believe to be true.

Further to my statement dated 01/05/05 regarding threats made by my ex partner Adrian FOSTER and Patrick Bernard O'MAHONEY who I know as "Bernie" I wish to state. I was the partner of FOSTER since January 1999. We moved in together later that year but in January 2000 he went abroad for five months. When he returned we moved back in together.

The same happened again the following year. In 2002 I purchased a bungalow at 2B Church Street, Baston with Adrian but we fei! out and I bought out his share when he moved out. He had a new girlfriend a married woman called Stacey GASKIN. In Feb or March 2003 we got back together and he moved back into the bungalow.

We had trouble with GASKIN's husband in Baston and so we rented a property in Frognall called "Meadowview" where we stayed until May 2004. During this time we had renovated the bungaiow which was sold in June 2004. After this I purchased 3 Station Road, Deeping St James for £300,000.00. I obtained the deposit 15% from the sale of my last house

A further £6,000.00 was borrowed from Adrian's parents for costs. We paid this back together. Adrian has a bad credit history if it hadn't been for that fact the mortgage would have been in joint names. Adrian was self employed as "Baston Building Solutions" which was registered in my name so that he could avoid paying the CSA for a child from his previous marriage. Apart from this he was generally not good with money and would spent it as he earnt it.

I run my own Company which was Ltd but I now run as a sole trader. My Company is called HALO and I provide temporary staff to new homes developers. I use about twenty women who temp as site sales staff. I paid the mortgage payments and other bills and he paid for our social life and miscellaneous items. I bought the sofa last July 04 for 2,500.00 and paid using my business account.

The TV I had paid Adrian for around 300.00 complete with VCR & DVD and speakers when we split up in Sept 2002. At that time I also paid off his outstanding motorbike finance of 7.000.00 and paid him 5000.00 which was his share of the equity in the house at that time.

The washing machine and tumble dryer were bought for cash for a total of 290.00 Because they were bought for cash it is most likely Adrian paid however this would have been his part of his contribution to the housekeeping. We lived together at 3 Station Road for about 6 months.

During this time Adrian would stay out late drinking and we spent more and more time apart. I was unhappy with Our relationship and on Boxing Day we split up. We still lived together and in early January I challenged Adrian after seeing him with another girl. During January I started seeing James COTTAM and spent more time away from the house. I asked Adrian to leave but he refused. He said he would pay me rent but he paid nothing.

Eventually sometime in March or April 2005 I had the locks changed. Since that time it has been "For Sale" and unoccupied. I removed most of the furniture on 12/3/05 when I got my new rented house at 17 Gilpin Close, Bourne where I now live with James.

I had left in the house a dining table 900.00 a chest in hallway 600.00 a refurbished bed 500.00 an X-box console which I had bought for 300.00 with games together with all his personal possessions, clothing etc. I think this is fair considering what he contributed towards the house. After this Adrian began to harass me by mobile telephone and Police warned him over this.

On and off I lived with FOSTER for approx 6 years and I would happily go to Civil Court over any property to which he lays claim. When we moved into Station Road in June 2004 Adrian changed his Company name to HALO Building Services. This was so we could share stationery and answer the phone as "HALO" together and not for tax or other monetary reasons.

I have known Bernie for about one year. I first met him in the pubs around Market Deeping as a friend of Adrians. Prior to meeting Bernie I had Heard of a fight he had been involved in at the Towngate Inn Pun when he had allegedly pulled all the optic bottles from the bar and smashed them. I had heard he was from Essex and had written a book called the "Essex Boys" about gangster life.

I have only read the first chapter in which Bernie talks about his upbringing Adrian had acquired a copy before I met him and I read it as I was intrigued why a person like that woul'd be living in Deeping. Also before meeting him I remember a night out in the Coach House Pub. I cannot recall the date.

I was sitting downstairs at a table near the bar when Bernie reached over and picked up my empty half pint glass. l had my back towards what happened next but there was a commotion outside the toilets. Afterwards saw a man covered in blood and the Police arrive and arrest Bernie.

Adrian was telling me not to look. Adrian later told me that he had done this so I would not get involved. This was because he knew of Bernie's reputation and he did not wish to put me in danger as a witness After we befriended Bernie we would see him usually in the Bell Pub or the Coach House most Fridays. We had invited Bernie and his partner Emma out for dinner on a couple of occasions but they never accepted.

I became quite good friends with Emma and Adrian and myself were invited to their wedding which we attended on Friday 10th July 2004. We were not close friends but Emma didn't know many people locally plus some of our friends Had been invited so we decided to go. Another person going to the wedding was a friend of Adrian's called Billy Jones.

He is a gypsy or traveller and I understand his father Alex owns Oxney Road caravan site in Peterborough. I have known him for approx 2 years and he jet skis locally. I am aware Bernie is alleging that I have paid some travellers to threaten him or do him harm this is not true.

Adrian told me on the phone around January that billy and his friend another traveller called "Bizzy" were going to kidnap James and hold him in a lorry for 48 hours and beat him up before releasing him. This was "because you don't take a mate's girlfriend" Adrian had also told me the "BRYLEY BROTHERS" had been paid to come from Essex to beat up James on the 20th January.

Again he told me this by telephone and by text around that time. My telephone then was the same one I refer to in my statement 1/5/05 no. 07710 758620 a contract phone with "o2". In January Adrian's phone was a contract phone in my name No. 0773 9909704 again with "o2".

I cut this phone off after Adrian ran up a 500.00 bill towards the end of March 2005. He then bought a pay as you go No. 07731 724760 with "02". He may have used the black coloured Samsung contract handset with this. This is the number he called on when I received his texts over the weekend 1/5/05.

We reported the threatening texts from Adrian and Bernie and attended Bourne Police Station to make a Statement to PC KITCHEN. James went first and I waited in the front reception. It was about 1545 when we arrived and about 2100 when we left.

The reception door was on the latch and at 1709 my phone rang. The display said "Bernie O'M" which relates to No. 07919 151295. This is the number he used for all his calls/texts that weekend. I walked through to the adjoining interview room where James and PC KITCHEN were sitting either side of a bench and I sat down next to James.

They had just finished James statement and were reading through it. I explained Bernie was calling before answering. I switched .the phone to loud speaker. The room was small and it was quiet. The door was shut and I heard O'MAHONEY's voice when he said "where are you, where's James".' Both myself James and PC KITCHEN then remained in the room until my statement was complete.

We all left the room momentarily at different times for toilet breaks etc. I was present when James phone rang shortly after. He answered it and moved around the desk forward to allow PC KITCHEN to hear. I could not clearly hear what was said. I was sitting next to James as his phone rang and could see the display was the same as on my phone "BERNIE O'M".

Although I could not hear what was said the voice sounded of Bernie who has a distinctive sound due to the different accents he has picked up as he lived in different parts of the country. James listened to the call for a second Before moving past me and around the desk to PC KITCHEN. James held the phone in between their ears only inches away.

As he PC KITCHEN was writing down what was said. Police inform me Bernie was arrested during the evening of Tuesday 3/05/05 and was remanded into custody. On Thursday 05/05/05 when Bernie was due to appear at Grantham Magistrates Court I received a call around mid morning which displayed private number.

The voice said "Is there anything that we can do to get the charges dropped against Pat" It was a local accent and not menacing but what was said caused me to fear what would happen if we did not drop the charges as he ended the message "I promise no one will hurt you". I said I would have to speak to James. I had a further call around midday wanting an answer.

I said I hadn't spoken to James and would call back later. From the person's voice and the things said I assumed it had been Billy Jones calling. I called him later that night I told him I wasn't sure what I wanted to do and if I decided to drop the charges I would call. I have not heard from him since. I did not regard this as intimidation but I am concerned of how things may develop.

My friends and family know of Bernie's reputation. They and I are concerned what he will do when released. I have seen first hand the violence Bernie is capable of and I am very nervous about giving evidence. I am not sleeping properly due to the anxiety and stress caused and I know James has been physically sick each morning this week due to the stress. I have cancelled a forth coming holiday as I am afraid to leave James alone.
