Comments on the statements of the prosecution witnesses

1. James Cottam

1.1 The first point I would make about the statement of Cottam is that my dispute with him goes back to the beginning of January 2005. This was long before Kirsty Jones left Foster and took Foster's possessions. Cottam is trying to distance Kirsty from me and portray his debt as part of a pact I had with Foster to get Foster's stuff back. This is how the police interpreted the story, as will be seen from the interview they had with me starting at 1628 hours on 4th May 2005 at page 6 "What I'm putting to you is that you've gone out to recover a debt on behalf of your friend, Adrian Foster".


1.2 On page 2 of Cottam's statement he refers to a telephone call I made to him soon after 6.25 pm on Friday 29th April 2005. During that telephone call I did not say "Pick a number between 1 and 10" nor did I say "Put 500 quid through my letter box before I get back then it will be over". I wanted £1,000.00 not £500.00 because at the time the job had not been finished and the outstanding work was worth at least £1,000.00.

1.3 Moreover on 29th April between 9.30 and 10.00 am I did not make a threat to Cottam in a telephone call saying "I'm going to cut you anyway and if you call the police I will slit your throat". I have never used the expression "slit your throat" in my life. Nor did I say "Stop fucking talking and listen to me. You do as I say and you won't get hurt'.

1.4 I accept that I sent a series of texts on the day I returned from Paris (Sunday 1st May 2005) as I was frustrated by the fact that Cottam had agreed to do the work and evidently had not done so (as I had heard(. I therefore wanted to speak to him on the telephone. He was evidently refusing to answer it. When I eventually did get through to Cottam I said something on the lines of "Why haven't you done what you agreed to do?" I did not say "I'm going to fucking kill you, I'm going to fucking kill you. Why make an agreement and not keep it. I'm coming up to the hospital now".

2 Kirsty Jones, 1st May 2005

2.1 It is quite true that on Friday 29th April 2005 at about 10.00 am Kirsty Jones telephoned me. I accept that I was annoyed that Cottam had not done the work or returned the money. It is nonsense that I said "Shut up you Pakicunt. You're a little shit. Tell your Paki loving boyfriend that I will slit his throat if he goes to the police". For one thing, Kirsty Jones is not white. For another, I have never used the expression "slit his throat" in my life.

2.2 I accept that reference may have been made to Adrian Foster's property but this was not the prime purpose of my conversations with Cottam and Jones. My motive in referring to Foster's property was that, in persuading Kirsty Jones to give Adrian some or all of his property back was that we had all been friends and I wanted to sort things out. Moreover, I wanted
Foster to finish the job for Cottam and Foster's property appeared to be a problem between them.

2.3 As regards the telephone call made at about 10.15 am I accept that I may have made the call but I do not understand the reference to "I'm coming to find him". I was on my way to Heathrow Airport to catch a flight to Paris at about 1.00 pm. I can produce documentary evidence in support. I would not have said "I'm coming round to your's now, I know where you live" for the same reason.

2.4 I did not telephone Kirsty Jones at 10.25 am saying that I was not coming and that I was going to look for "James".

2.5 Moreover, although I may have made a telephone call at about 5.30 pm to Cottam's mobile, I deny saying "Where's that little prick. If he calls the police I'm going to slit his throat". I say again that I have never used the expression "slit his throat in my life".

2.6 Although at about the same time I sent a text to Cottam saying that the debt would be "1500 tomorrow" this was just "talk" and was not intended to be taken seriously. Similarly I may have said something on the same lines at around the same time on the telephone. I was certainly trying to get Cottam to telephone me.

2.7 The subsequent exchange of texts between Kirsty Jones and Adrian Foster are of no concern to me. I had no input into them. I did not cause Foster to say anything to Jones that is referred to in those texts. Nothing that Foster may have said during this series of texts was authorised by me.

2.8 I note that in one text Jones says that she replied that "It was a good job that was done on the floor at £30.00 a metre". I do not know how Jones would know anything about that as she had never seen the job done as far as I am aware. I do not see how she could possibly comment with any ability.

2.9 I note that at 1613 hours on 1st May Jones received a text from Foster saying "I've got you more time to make me an offer. I will be with him later. Cottam will probably get a call". It is not true that Foster had consulted me in the meantime as I was flying back from Paris and did not have access to my mobile telephone at this time.

2.10 I specifically deny that when Foster texted Jones at 1731 hours on 1st May "Kirsty if you're in the hospital get out. B has gone nuts. I'm sorry". No such text was sent upon my authority or with my knowledge.

3 Roger James Kitchen (4th May 2005)

3.1 I note that this version of what he claims to have heard being said by "Bernie" differs from what Cottam says I said on the telephone. In any event I deny that I threatened to cut Cottam to pieces (P C Kitchen) or that I said "I'm going to fucking kill you, I 'm going to fucking kill you, why make an agreement and not keep it. I'm coming up to the hospital now". (Cottam).
