MR LATHAM
Mr Day, your full names, please? SCOTT
DAY
Scott Kerry Day. MR LATHAM
Mr Day, I think you live in the Soham area, don't you
? SCOTT DAY
yes. MR LATHAM
and you are a friend of Kevin Wells ? SCOTT
DAY
yes. MR LATHAM
Sunday, 4th August last year I think you were at home
in the late evening when you got a telephone call?
SCOTT DAY
that's correct. MR LATHAM
The call was from? SCOTT DAY
from Kevin. MR LATHAM
yes. I think he informed you that Holly had disappeared
and he was asking for your help, wasn't he?
SCOTT DAY
yes, he was . MR LATHAM
shortly after the call, at about quarter past ten, did
he turn up at your home? SCOTT DAY
yes, he did, yes. MR LATHAM
and what did the two of you do? SCOTT
DAY
we got in my van and---- MR LATHAM
keep your voice up. going to your van? SCOTT
DAY
yes, I we got in my van and proceeded to obviously drive
around the near area and then later on went up to the
school. MR LATHAM
can you help us with approximately what time it was that
you got to the area of the school? I'm not asking for
an exact time, the best you can do? SCOTT
DAY
approximately about 11, quarter past 11. MR
LATHAM
yes. how did you get on to the College site in your van?
what route did you use? SCOTT DAY
we went down Sand Street, round past---- MR
LATHAM
past the war memorial roundabout? SCOTT
DAY
yes. MR LATHAM
Clay Street? SCOTT DAY
sorry, Clay Street. MR LATHAM
down into College Road? SCOTT DAY
exactly right. MR LATHAM
now, once you get into what I'm going to describe as the
College site there is a limited number of routes you can
take. Where in fact did you drive? SCOTT
DAY
we drove past the Lodeside School---- MR
LATHAM
Yes? SCOTT DAY
----up towards the sports centre entrance instead of going
straight on into the car park in the sports centre, turned
right to the concrete path that runs past the entrance
of the sports centre with Lodeside on the right-hand side
and Beechurst to the left. MR LATHAM
That is a straight concrete path which leads up with Beechurst
on the left and the tennis courts on the right at the
top and then joins the main entrance to the junior school
and the car park at the top, isn't it? SCOTT
DAY
Yes, exactly. MR LATHAM
Were you familiar with that road before that night?
SCOTT DAY
I went to Soham Village College so yes, I knew all the
area. MR LATHAM
As you were driving up the road you have just described,
did you see someone? SCOTT DAY
Yes. MR LATHAM
Where were you and where was the person? SCOTT
DAY
We was just beyond the sports centre towards the (INAUDIBLE)
and on the right hand side. MR LATHAM
I understand there is no dispute about the identity of
the person, did you know Mr Huntley before that night?
SCOTT DAY
I didn't know him, I knew of him. MR
LATHAM
Yes. Would you have recognised him and linked him to the
school? SCOTT DAY
Yes, I would, yes. MR LATHAM
Did you know him that is caretaker, the site caretaker?
SCOTT DAY
Yes. MR LATHAM
And what was he doing when you saw him? SCOTT
DAY
He was just walking along with his dog. MR
LATHAM
Is the dog on a lead? SCOTT DAY
No. MR LATHAM
Did you carry on past him? SCOTT DAY
Yes, we did . MR LATHAM
Then what did you do? SCOTT DAY
We went up to the St Andrew's school and Kevin - the front
of St Andrew's school, Kevin got out the van.
MR LATHAM
He parked in the car parking area? SCOTT
DAY
Just beyond the car park, the car park just before we
drove through car park and there is---. MR
LATHAM
A turning circle? SCOTT DAY
Exactly right. A turning circle and we stopped there.
MR LATHAM
Kevin got out of the car did you remain in the van?
SCOTT DAY
Yes. MR LATHAM
Windows up or down? SCOTT DAY
The window was down. MR LATHAM
What did Kevin do? SCOTT DAY
Kevin called across the fields, the playing fields for
Holly and Jessica. MR LATHAM
When you say called across the playing fields, I mean
how loud was this? SCOTT DAY
As loud as he could possibly call. MR
LATHAM
Did that result in anything or not? SCOTT
DAY
No, Kevin done it two or three times, we obviously waited
hoping for a response out of the darkness and then that
was it. MR LATHAM
Right. So did he then get back into your van?
SCOTT DAY
Yes, he did. MR LATHAM
And what did you do then? SCOTT DAY
Done a U-turn and went back through the car park and back
along? MR LATHAM
On the way back down towards the sports centre and the
car park at the front of Lodeside, did you see anyone
again? SCOTT DAY
Yes. MR LATHAM
Who? SCOTT DAY
Ian Huntley. MR LATHAM
What happened on this occasion? SCOTT
DAY
As we drove past, just acknowledged. MR
LATHAM
He acknowledged you, did he? SCOTT DAY
I thought he did. One hand was on the staring wheel, spare
hand up and just nodded. MR LATHAM
Nodded? SCOTT DAY
Yes, didn't really look to see the response but I assumed.
MR LATHAM
How long had you worked on the site? SCOTT
DAY
How long, sorry. MR LATHAM
Had you worked on the site? SCOTT DAY
He or I worked. MR LATHAM
You? SCOTT DAY
Possibly about three months we used to go up to the college
after evening classes and lock-up. MR
LATHAM
I think there was an overlap period? SCOTT
DAY
There was, yes on Huntley's days off we still go up there
and lock-up on those occasions. MR LATHAM
Now, how long did you carry on searching that night?
SCOTT DAY
The entire night, right the way through until morning,
probably five o'clock in the morning. MR
LATHAM
Did something else happen later on in the night?
SCOTT DAY
Yes, we had been searching extensively around Burwell,
places like that, and then Kevin wanted to go back to
the school and have a look round there again.
MR LATHAM
I think by then you had been joined by Robert Wight, hadn't
you? SCOTT DAY
Yes. MR LATHAM
Had you understood that in fact Robert Wright had been
with the family earlier that day, at the barbecue?
SCOTT DAY
Yes. MR LATHAM
I think he had his own car with him? SCOTT
DAY
Yes, yes. MR LATHAM
Did you end up outside the school? SCOTT
DAY
Yes. MR LATHAM
In the two vehicles? SCOTT DAY
No, he was in the one vehicle. MR LATHAM
You were in the one in Robert's by then? SCOTT
DAY
Yes, we were in Robert's then. MR LATHAM
Members of the Jury, page 7 of your chronology. What sort
of time was this, again, I appreciate an approximate time
but? SCOTT DAY
Approximately about half past four. MR
LATHAM
In the morning? And did you park in the, I say you, did
Robert Wright park you all in the parking area in front
of the Lodeside college? SCOTT DAY
Yes. MR LATHAM
Did you notice something about the college?
SCOTT DAY
As we walked past the college we noticed one of the lights
was on in the offices. MR LATHAM
Something about one of the doors? SCOTT
DAY
The Lodeside where the sports centre is, the sports bit,
is the door was open. MR LATHAM
What did you do? SCOTT DAY
We went through the door and just called out hello, see
if anybody was there. MR LATHAM
Yes. What was the next thing you were confronted by?
SCOTT DAY
The dog came running down the corridor towards us.
MR LATHAM
And what did you all do when the dog appeared?
SCOTT DAY
Obviously not knowing what the dog is like we kind of
backed out of the door, closed the door behind us.
MR LATHAM
Did somebody else appear? SCOTT DAY
Yes, Ian Huntley came down behind the dog. MR
LATHAM
Yes, you have said you had seen him the previous night.
Can you say anything about his appearance, his clothing,
in relation to the man you had seen the previous night?
SCOTT DAY
he appeared to be wearing the same clothes.
MR LATHAM
did Kevin say something to him? SCOTT
DAY
he said he was out looking for the girls and - out looking
for the girls. MR LATHAM
did he say something? SCOTT DAY
he said he was just in his office, writing a note to say
that he had been up all night with the police and that
he would be late in in the morning. MR
LATHAM
and did Kevin then tell Ian Huntley what he was going
to do next? SCOTT DAY
yes, he did, he said he was going to have another look
round the playing fields and storeroom. MR
LATHAM
and what did Huntley say about that? SCOTT
DAY
he said that he had been there, let the police in and
he had the dogs around there, sniffer dogs around there,
looking around there. MR LATHAM
what was he in effect indicating? SCOTT
DAY
they had already been searched. MR LATHAM
yes. And what did Kevin say to that? SCOTT
DAY
he said, well, we may as well call it a day.
MR LATHAM
when Kevin had first, when you announced that you were
out looking for the girls, can you remember the words
he used, what was the indication, what was the description
of what he was about, or you were about, to Ian Huntley
- that you were about doing what? SCOTT
DAY
sorry. MR LATHAM
when you first spoke or Kevin Wells spoke? SCOTT
DAY
spoke to Ian. MR LATHAM
spoke to Ian Huntley at about 4.30 in the morning, can
you remember, as best you can, the explanation he gave
for what he was doing at the site? SCOTT
DAY
yes, he said that he was in his office writing a letter.
MR LATHAM
no, what did Kevin explain to Huntley? SCOTT
DAY
Oh, Kevin just said to Huntley that Jessica and Holly
were missing. MR LATHAM
the words he used did he name the two girls?
SCOTT DAY
I cannot specifically recall. MR LATHAM
if he didn't name the two girls, did he say how many people
you were looking for? SCOTT DAY
again, I can't specifically recall. MR
LATHAM
how did he describe what the three of you were about?
SCOTT DAY
I thought, I'm sure he said we was out looking for the
missing girls. MR LATHAM
missing girls? now, did, Huntley when he was asked that,
ask for any further and better particulars of what you
were looking for? SCOTT DAY
no. no. MR JUSTICE MOSES
(inaudible) Further and better----? MR
LATHAM
further and better particulars, I apologise for using
that legalese. MR LATHAM
will you wait there, please, Mr Day. Cross-examined by
MR COWARD MR
COWARD
could it possibly have been a little earlier than 11-ish
when you saw the man you know now to be Mr Huntley for
the first time? SCOTT DAY
I don't think so, no. MR COWARD
How did you work it out? SCOTT DAY
Kevin came round at 12 minutes past, because I was in
bed. MR COWARD
12 minutes past 10? SCOTT DAY
12 minutes past 10, yes I remember being in bed looking
at the clock and he came round, (inaudible) he lives two
minutes round the corner and he was out searching the
surrounding area. Kevin had just come back from the school
so----. MR COWARD
Searching in the town area? SCOTT DAY
The town area including down the by-pass and it did take
a little while so we went to Ely as well. MR
COWARD
When you saw the man who turned out to be Mr Huntley,
the man with the dog, he was near the sports centre?
SCOTT DAY
Yes. MR COWARD
You were in the van with Mr Wells, drove down towards
St Andrew's school, there is a parking area there, you
parked and went on to the playing fields? SCOTT
DAY
No, we drove through the parking area and then parked
right outside the school where there is no parking area,
it is just--- and we never went on to the playing fields
at that point. Kevin- I stayed in the vehicle, Kevin got
out of the vehicle and stood just to the left-hand front
of the vehicle on the road on the turn round part and
called from there. MR COWARD
And was calling across? SCOTT DAY
Across the playing fields. MR COWARD
Surely the measure, your estimate of how far it is from
the sports centre to where the car was parked?
SCOTT DAY
Rough estimate would be approximately 200 yards.
MR COWARD
Mr Day you have been asked questions about exactly what
it was that Mr Wells said to Mr Huntley when he came out
of the office with the dog? SCOTT DAY
Yes. MR COWARD
I am looking at a statement of yours, dated 8th September
you say this "Kevin said to Huntley we are just out
looking for two missing girls". That fits in with
your memory now? SCOTT DAY
Yes. MR COWARD
Thank you very much. MR HUBBARD
No questions. MR JUSTICE MOSES
Thank you very much (the witness withdrew).
