??/??/?? - PROOF OF EVIDENCE - Barry Chart
I, BERNARD PATRICK KING (aka O'Mahoney), of Basildon
in the County of Essex WILL SAY AS FOLLOWS:
1) I live at Basildon in the County of Essex on my own
which is a three bedroomed rented house. I have lived
there for the past four years. I was employed as a doorman
by Rainbird Security. I work at Raquels, The Buzz Bar
and was a head doorman there for five years. I have
now had to give up work and claim sickness benefit because
of a nervous disorder.
2) I am under suspicion in relation to matters of criminal
damage and affray which took place during January of
1995. On that day I was on duty at the Buzz Bar as usual
together with my co-doorman, Gaven Spicer. There was
trouble that evening however as a firm of doormen who
were trying to make inroads in to the work in Basildon
came up from Mile End specifically in order to cause
trouble. They entered the Buzz Bar and started being
abusive to staff and customers.
It was not too bad and fairly quiet at first but it
became worse. At 11 o'clock, it was closing time in
any event and I asked one of the doormen to leave. As
I was escorting him out of the premises down some stairs,
I felt a sharp blow to the back of my head as I was
struck behind by an assailant. I believe Gaven Spicer
was also struck, there was a general fight or melee
on the stairs.
A number of people fell down the stairs there was a
struggle I did not know exactly what happened I tried
to get people out of the building apart from the blow
to the back of my head which caused the bruise, I did
not receive any other injuries but one of the trouble
makers received a broken arm and a suspected broken
rib.
The trouble makers with the exception of the one that
was injured and customers were ushered out of the premises
and I left the premises after locking up at about 11.20
am together with Gavin Spicer and two female promoters
that work with Raquels. I believe all of this is captured
upon video camera including my leaving the club.
3) Apparently later on, in the early hours of the following
morning at about 1 o'clock or so there was a further
disturbance near Raquels during which an innocent bystander
or a supposedly innocent bystander had his Fiesta car,
(I believe), had the windscreen and side window smashed
by two people, one of whom he claims is me.
I can say that at no time did I damage that car, nor
was I part of any criminal activity on that night. I
am now required to attend an ID parade at 4.30 on the
2nd of March next and have agreed to stand on the parade/group
identification on that day.
4) I do have previous convictions but not now for 8
years or so. I have had good relations with the police
and have enjoyed steady employment without trouble in
my job as doorman for the past five years. I am now
in receipt of sickness benefit of £45-58 per week
as a result of this nervous disorder although I have
suffered now for some time which has now become sufficiently
bad to prevent me from working.
5) I will be able to give a fuller proof of evidence
if that should be necessary once I have attended the
ID parade and after my solicitor has received advance
disclosure should the matter come to it.
6) I believe I am likely to be picked out at the ID
parade because the person that alleges I damaged their
car is either Green or Williams, I am not sure which
but he is a man that has been banned from the club for
assaulting his girlfriend in the club. Although I was
not personally responsible for throwing him out of the
club on the night in question because I was the head
doorman, everything comes down to my responsibility.
The girlfriend has already visited me at the club and
apologised for the behaviour of her boyfriend and indicated
to me that she believed that the boyfriend had made
these allegations against me in order to get his own
back on me for being banned from the club. It is for
these reason I believe that he claimed that I have damaged
his car and as he knows me as the doorman, he should
be able to pick me out on that day in question.
I will not give an interview to the police as I believe
DC Palmer has tunnel vision and has already made up
his mind that I am a guilty party and I have no intention
of speaking to him because of his attitude.
