Q. Do any of his statements or transcripts contain untruths?
Get Nichols to confirm the following quotes
Nichols is told by D.I Barrington (3/4 14.5.96) "You
must be totally honest in all details given".
(10/9 20.5.96) "Everything I have told you about your
enquiries is absolutely true". Quote by Nichols.
D.I Barrington informs us, Nichols will be giving information
(3/4 14.5.96) regarding illegal activities of policemen"
(He is obviously aware of this).
Unused DJM/1AA (Bird phone tapes 10.5.96 pg 12) Nichols remarks
" The more illegal the better, right"? to D C Bird
During the same phone call conspires with D.C Bird to board
a ferry and steal £150k + cash from the boot of a vehicle.
(Tape counter number end of tape)
Also during same tape, conspires to supply B.M.K (Benzol Methyl
Ketone) to produce amphetamine (speed) with D.C Bird. This
is an attempt to fit up previous co-de's Mick And John Donnelly.
Same tape once again, conspires with D C Bird to supply drugs
to the general public...,Quote by Nichols "I'll dish
it out like sweets"
Q. So prior to your arrest, you clearly feel your activities
with relation to D.C Bird. "The more illegal the better"....
You intend creating an amphetamine factory, to which you will
dish it out like sweets Along the way you hope to fit up Mick
and John Donnelly and in the interim you plan to steal money
from the boot of a car. You should have no trouble agreeing
with me, that you have willingly and knowingly conspired with
the Policeman D.C Bird to perform major criminal acts, hoping
to hide behind the Police federation coat of arms as a shield?
I put to you at this stage Mr Nichols, throughout your many
statements and interviews you attempt to blend "Fact
into Fiction" You do so, to corroborate your factitious
plot to give it an essence of truth, to make it more believable
Q. E G:- You yourself dispose of a large amount of cannabis
resin into a water filled pit, local to your own town of Braintree
in Essex. (1/V A 15.5.96 pg 17)?
Q. Your alleged initiation, if we can call it that, into being
a paid police informer, under the guidance of D.C Bird, is
to enlighten Bird as to the whereabouts of this consignment
of drugs which you have dumped?
Q. This very same consignment of cannabis resin, after your
arrest, you put forward as a motive for murder? (Unused 18
9 96 pg 7. 3)
Q. You do not inform D C Bird that this cannabis resin was
a motive for murder?
This last question may produce an affirmative, that he did
inform D.C Bird of its importance in relation to the Rettendon
Murders. In which case following contradicts, and also brands
him a liar!(Nichols / Apache 18.9.96 pg 2,3, 6)
Q. Quote:- "I considered carefully whether I should give
information; I hadn't done it before, so I was unaware of
Police procedures adopted, and how the information would be
used, and above all how i would be protected against anyone
finding out. .... I decided I would give him some information
I considered fairly safe by way of a test, to see if he could
be trusted. I decided to tell him about a large amount of
cannabis resin, 50 kilos which I had thrown in the arc pjts.
I decided to tell Bird about this particular cannabis as I
felt it would be safe information that would not lead to anyone
being arrested. I felt any fingerprints on the cannabis would
have disappeared, including mine, while it was in the water
for so long".
Q. You tell Bird of the cannabis resin. You actually lead
him to the spot, and point out the exact area to enable him
to recover it, with the aid of Police divers. (1/V A (15.5
96 pg 17)?
Q. Once recovered, Birds first move is to inform his superiors,
and to request a cash reward of £500 for his informant?
Q. Unable to tell his D.I his own snoop dumped the cannabis
himself, you conspire between you, to dream up a false story
as to how you knew the cannabis resin was in the pit? (1/V
A 15.5.96 pg 23) (1/V C pg 78).
Q. You then blend fact with fiction. Your fiction is to eavesdrop
a conversation in a public house. Two men are discussing where
they have dumped 50 kilos in a lake. You enhance your fiction
with Malicious Fact, You name two innocent men as the loose
tongued conspirators, a Tim Brown and Dave Whiteman, along
with the name of a public house, the Tabor Arms, in the Panfied
Way Braintree. You use a known public house, and the names
you put forward are the Landlord and his tenant, just to enhance
your deliberate lie?
Q. (1/V A 15.5.96 pg 23) You are so convincing with your lie,
you are paid £400 cash as a reward. You dupe a high
ranking Police Officer to pay you £400 by concocting
an elaborate lie with the aid of D.C Bird? (1/VCpg 78)(1VC
pg 82)(C pg 83)
Q. Later during questioning you find it amusing that you are
paid £400 of taxpayers money, for informing Police of
a consignment of cannabis resin which you yourself have put
there?
Q. Throughout your many interviews you claim to be forwarding
information onto D.C Bird with relation to drug importations.
Were you given any cash rewards for this alleged information?
(No)
Q. If you are informing, and you are a paid informant, why
not?
Q. Another example of Nichols "Fact into Fiction"
and obvious lies during interview (15.5.96 1/V B pg 47), when
D.C Brown questions Nichols as to his response when D.C Bird
entices Nichols to steal cash from the boot of a car, during
a ferry crossing.
This same point and response is repeated by Nichols in yet
another interview with D.I McIntyre. (1/V 22.5.96 D pg 100)
On (1/V 6.6.95 F pg 117-120) D.I McIntyre plays Nichols the
tape recording of the telephone conversation between himself
and D.C Bird, which totally contradicts what Nichols has been
saying. He is once again found to be lying and blending Fact
into Fiction!
Q Can you tell us why, aftey repeatedly lying to Police during
interview, that you now appear on their behalf as their principal
witness?
Q. Apart from your obvious illegal activities with D.C Bird,
have you since your arrest, entered into any further conspiratous
activities with any other Police Officers in an attempt to
pervert the course of justice even further?
Q. Do you recall saying (committal 21.10.96 Tricia Lynch X
exam pg 28).. ."I wasn't making a very good job of not
telling the truth, because when you don't tell the truth,
you cannot remember what you said at a later date It is diffcult
to remember when you're not telling the truth. I get things
in the wrong order anyway"?
Q. Do you also recall... "After a little while with the
Police, I initially thought I couldn't trust them, and I would
be hanging myself?
Q. Why should you have to trust the Police, if you are telling
the truth?
Q. Why should you be hanging yourself if you are telling the
truth?
Q. During your many taped interviews, did Police at any time
stop the tape to speak to you, or to brief you about any aspects
of their enquiries?
Q. Were you at any time, prior to a taped interview told what
to say on tape under interview?
Q. Did Police at any time during interview, whisper any instructions
to you?
Q. Were you openly influenced by Police during interview with
such things as descriptions of bags, or where bags or clothing
were put?
If Nichols claims Police do not stop tape during interview,
draw his attention to (David Davis X examination Commital
23.19.96 pg 16 line 3, which corresponds with 1/V 3/8 10 20.
"They obviously stop the tape"!
Q. During Police custody, your custody record indicates prolonged
cell visits from D.C Brown and D.C Winstone, to name but two.
What were you discussing during these visits, some of which
exceed a duration of two hour or more? (See Steeles decipher
of Nichols custody record for clarity and quick reference)
This suspect area of Police corruption during interview will
become apparent after tape analysis has been completed.
Q. You were of the opinion, or led to believe, that your taped
interviews were privy only to the Police and the C.P S? (1/V
3/5 Committal 15.10.96 pg 26)
Q. What gave you the impression, that Police were allowed
to edit your taped interviews? (4/9) Quote:- "chuck some
out and then".
Q. There are a number of quotes which you make during interview,
which would indicate you are clearly conspiring with the Police
officers D.C Brown, D.C Winstone and D.C Bird to pervert the
course of justice, unless you have a feasible explanation
for them:-
(4/32) "I've fucked the story up again"!
(6/21) "I lost the plot there for a minute"!
(30) "I'm losing the plot there for a minute"!
(14/33) "Oh no sorry, I don't know if I'm off the track...
I can't really. .."
(7/33) "I'm gonna say things wrong or remember them later"!
(7/35) "See me through it if I. remember"!
(9/27) "I'm hoping you'll remind me of things i can't
remember"!
(4/32) "I'll get it in the right order soon"!
Put Nichols, these quotation imply a conspiracy. Allow him
his explanation to the contrary, then nail him with the following
excerpts, which conclude, he is a liar, fabricator and a conspirator
!
Q. You are a firm believer Mr Nichols that you have to have
an excellent memory to be a good liar, (committal pg 28) Let
me show you the weakness of yours!

on that last time on that importation when you got him, that
was every penny he possessed, trying to buy drugs to make
money"!

We can now use a further three quotes to blacken Nichols further
on this issue:-

Q. Your statements clearly indicate, that you are in actual
fact conspiring with Police Officers to fabricate evidence....
In order to set up defendants, to send them to prison for
the rest of their lives?
(N/Apache 5.7.96 pg 18) Quote...."and then i had him
in mind about other things, before like I was gonna tell him
to perhaps he could help me out with you know.... getting
rid of a couple of people what I didn't like ... I thought
i'd set em up to set em nicked"!!
(N/Apache 5.7.96 pg 18) Quote.... "I wanted them arrested
for drug smuggling, so they were out of my life, cos if they
were arrested for murder, there's only one person that could
possibly say who'd done it...... They were out of my life,
they're gonna do at least 15 years you know. If your gonna
be away for say at least 10 years that's quite good ain't
it you know.. He ain't young, perhaps he'll die if i was lucky
when he was away y'know. I couldn't go and say like i know
who done the murder"!
Q. You are clearly telling us here Mr Nichols, that even prior
to your initiation as an alleged Police informer, your aim
was you set up Steele and Whomes to get them nicked?
Q. Why do you have to embark on a crime wave with D.C Bird
in order to set up Steele and Whomes, when all you have to
do is inform the Police of their alleged part in a triple
Murder?
Q. If you get paid £400 for telling police where you
dump 50 odd kilos of cannabis, just think what you would have
got for solving a triple murder for them.. Did this not enter
your mind? (Nichols statement pg 22 par 3)
Q. You tell us Steele and Whomes had a pact between them,
they would both shoot their victims, so neither would be able
to tell on the other at a later date?
Q. You want us to believe, that this very clever man Steele,
has this pact with Whomes, and leaves loose ends about, such
as you?
Q. Your close friend "Colin Bridge" is aware that
you are a drug dealer? (Bridge 14.5.96 13.40hrs pg 6,9) (Bridge
30.7.96 Con/Wit pg 388 par 4)
Q. Are you aware that your friend Colin Bridge has previous
convictions for "Child Abuse"?
Q. You employ Colin Bridge as a general gopher, He picks up
Vehicles for you, does a bit of driving, general labourer?

Q. Mr Steele indeed pays Mr Bridge to work as a labourer at
Meadow Cottage. Honest law abiding work that is?
Q. On the 13th May 95 you employ Colin Bridge to travel with
you in convoy to retrieve 10 kilos of cannabis resin. You
are driving your Jaguar XJ 6 and Bridge is driving your Transit
Van?
Q. You retrieve 10 kilos of cannabis with a street value of
£25k. You place this cannabis into a tool box and eventually
put it into the rear of the Transit Van which Bridge is driving,
In convoy you then head for Braintree along the A12?
