FURTHER POINTS TO COVER AT MURDER SCENE

1. Nichols alleged weapon used. Sawn off side by side shot gun and pump action. Nichols never sees a complete gun just bits of a sawn off gun barrels. He never sees a full length pump action, which is almost 4ft long, but is told of it later at Meadow Cottage!

2. Crucial alleged number of shots fired. Steele 4 Whomes 6, giving 10 rounds. Although never seen, just told of it, Nichols tells us the pump action holds quite a few rounds. Yet.... Whomes has to re-load this pump action after just 3 shots? Because of Nichols poor memory, this would make an excellent cross examination point.

Victims receive 8 wounds. Tucker 3 to head, Rolfe 2 to head, Tate 2 to head and one to body.

Just 7 shells are found at scene of crime, yet victims receive 8 gun shot wounds in total.

Two crucial points emerge from these facts. It is plausible that one shot causes two wounds.

The first initially into Tates head, which becomes a deflective shot, which finally strikes Tucker in the back of the head, sitting directly in front of Tate. This would account for Tucker receiving what would appear to be 3 shots to the head after a systematic two shots per victim.

The spent cartridges appear to be found in unauthentic situations about the murder scene, which would indicate contamination and an abundance of coolness!

Photographs reveal a spent cartridge case tucked under the front o/s road wheel. We are told another lies in the drivers door glove pocket, and that one is found in the rear o/s passenger footwell.

These three cartridges indicate irregular ejection. Only one could be explained by reasonable theory, such as a ricochet, which would place the cartridge in the rear o/s floor well.

The spent shells found by the front o/s road wheel and another in the drivers door glove box indicate contamination.

It is odd that no photographs were produced of the spent cartridge case in the R/O/S footwell!

3. Nichols claims Tate does two remarkable feats during his assassination..."he squeals like a baby", ....Smashes the rear o/s door drop glass, with his fist!

We can see from the photography that the drop glass is broken. Pathologists however, reveal glass splinters in Tates head wounds, which would indicate the window has been fired through. Tates posture in situ would not indicate any such action as Nichols describes. Tate of course holds his mobile phone in his right hand at time of death.

Tates alleged comments whilst being shot, merely mimic media coverage, a story by Steve "Nipper" Ellis, who claimed Tate squealed Iike a pig, when he was being shot More of Nichols Fact into Fiction.

One has to consider of course, if one would hear such squeals over the din of a shot gun discharge,

It is also evident, that the victims did not know much about the actual shooting. Rapidity appears to have been of essence.

It will no doubt be an argued point by the prosecution, how did Nichols know of a broken drop glass. Simple. The man admits to being there.

4. Alleged murder vehicle is a B reg, V.W Passat which originates from Nichols. Shortly after 6.12.93 it becomes the property of John O'Conner who among other things claims the vehicle had an exhaust that blew and leaked oil. (Confidential witness page 400)

Police scientists can find no evidence to place this V.W Passatt at the scene of the crime. Not even oil spillage!

Police scientists confirm gun residue is present on the rear seat of this Passat, although it is inconsistent with spent cartridge residue found at scene of the crime.

Police take statements from various witnesses who have used this vehicle to clarify if anyone has transported weapons in it. Albeit one such person holds a shotgun licence and of course owns guns.

Another user of this vehicle is Roy French (confidential witness pgs 261 and 385 to 387) the man Nichols allegedly approaches to purchase a gun for and on behalf of Steele. French denies ever carrying a gun in this vehicle.

However! Police fail to confirm, if Nichols actually approaches French to purchase a gun!

Or.... to see if French knows the illusive gypsy Mattey who allegedly knocks on Nichols door 3 days post murders to sell him a 9 shot pump action shot gun

No statement is ever taken from the close friend of D.C Bird namely Dave Trunley, who is the employer of Nichols by way of sub contracting Trunley owns many shotguns and is a regular at clay pigeon shoots, when they use the services of Nichols as a chauffeur, as heavy drinking follows such meetings.

Suicide Jockey Bridge makes an interesting comment on Tape He advises to keep clear of these people when they've had a drink, as they're likely to blow your head off!

5. What are we expected to believe, is that two intelligent men, plan a professional assassination, of copybook proportions, then decide to use a worn out V W Passat, with leaking exhaust system and it's torque converter leaking oil, which is why Nichols dumped the vehicle in the first place.

As a last resort they dupe "Fat Man" into driving them to and from a murder scene, regardless of false number plates!

Nichols tells us the Passat has been got rid of guns are destroyed and clothing burnt!

"Fact".... there were no guns or clothing to destroy, hence "fact into Fiction" is destroyed when Police to their surprise recover the V.W Passat.

What possible reason would either Whomes or Steele be telling Nichols a vehicle is destroyed, at least 10 shots are fired into the victims, if it is totally false.. .Why would they be telling him lies?

Because Nichols believes Whomes has got rid of the V.W Passat, at Nichols request, Whomes leads Nichols to believe it has been destroyed, but in reality has given it to an associate, for the use of Hardly the act of a man who has ground up guns, attempting to destroy evidence.

Whomes allegedly has left the murder scene in this vehicle, and must witness a near collision with another vehicle, yet nonchalantly gives the vehicle away, instead of destroying it!

Nichols poor memory at work:-

(1/V 8/30 17.5.96 pg 30).... "destroyed the guns they used, nothing left of it whatsoever, and got rid of the car.....

Notice he speaks of guns (plural) and slips into (singular) "of it"

(Nichols statement 22.5.96 pg 23) "Mick told me the car bad been disposed of and wouldn't be found"!

(Committal 15.10.96 pg 19) I never saw the Passat again, I don't think I had any conversations with anyone about the Passat. I had a conversation with Micky Steele about clothing!

(Committal 21.10.96 Tricia Lynch pg 33) I think I had spoked to Michael Steele about the Passat after the murder. I recollected "they" said it would not be found

"Police influence has clearly been at work here during the 6 day committal recess"! You cannot be so mixed up, so confused over a genuine fact of life.

(1/V 17.5 96 pg 5/15) The first paragraph on this page has to be read to be appreciated. However the punch line is .... "I don't know about the car, what he was going to do with the car".

(4/12 14.5 96) Quote. "He said, i don't want to be at a deal in my car in case something goes wrong" !

Allegedly Steele owns this car!

6. Much ado is made of a closed gate at the scene of crime. Nichols knowledge of it that is!

Evidence has shown that this gate is chained and padlocked..

The crime scene of course was shown on National television. Police officers were seen searching the area and a glimpse of an adjoining field was shown. There was, and had been since, much media coverage on this issue, showing a closed gate and Range Rover in situ, Nichols covers this feature as follows:-

(1/V 8/37 17.5.96) "Jack said to Mick, i don't know when....fucking hell the gate was locked. I thought we've blown it....apparently there's a gate down there. l've never been down there just for the sake of it. I dont think i probably ever will.. this probably happened in the car actually"! ... continued....

(1/V 9/18 20.5.96)... "The idea was to get them into the field not keep them in the lane. I don't know why the gate was locked".

(1/V 9/19 20.5.96) "I don't know what gate. I've never seen it".

(Statement 22.5.96 pg 22)... "he thought they had blown it because the gate was locked. I do not know how he knew the gate was locked"

(Committal 14.10.96 pg 17) .... "When they stopped down the lane, a gate had been shut, so I got out the Range Rover. I didn't know where Jack was"....

POINTS

Notice... the minute Nichols is away from Police influence, the gate is merely "shut" not "locked". Which is indicated by media coverage.

If Nichols has never seen the gate, how does he know it opens out into a field Could it not be a gate mid lane or at the T junction?

Nichols tells us he's never been down the lane for the sake of it....yet (Colin Bridge 30.7.96 pg 6) tells us during December .95, whilst on their way to Southend, Nichols points out the lane to Bridge, where three men are murdered.

There's an old saying...."A murderer always returns to the scene of the crime" Has Nichols been subject to observation at the murder scene, which brings him initially into the frame?

The idea he tells us, is to get them into the field, out of the lane! Where then is the assassin likely to conceal himself?

Or was the assassin in the vehicle, perhaps with one man dead already, intent on dumping the body into a lake. Then surprised the other two when arriving at the gate ... We must not forget where spent cartridge cases are found?

You will of course notice, Nichols claims the gate is locked in interview. He never mentions chained or padlocked!

Nichols next mistake is LOVER LANE... When asked if he knows the name of the Lane, and how did Steele know of it's existence!

Nichols poor memory drops into gear, like a gear box with no synchromesh, We then get More Fact into Fiction.

Media coverage announced that Workhouse Lane was popular with courting couples. This is Nichols piece of fact. His Action swiftly follows: -

(1/V 9/16 20.5.96).... "Do you know what that Lane is called Darren"?.. "I've got no idea"!

..." I said how did you know about this place, did you fly over it.... and he said NO! .. I used to take girlfriends there when I was younger... .like a LOVERS LANE"!

9/17 Nichols enters into verbal diarrhoea, attempting to establish an assumed lover for Steele, which must be quoted in court to embarrass Nichols and humour the jury!

(1/V 9/18).. .before he bought his first house he was taking women down LOVERS LANE. I don't know how, I don't know a lot about the bloke. ..I said How did you spot this place did you fly over it", and he said NO! I used it as LOVERS LANE. It's always used as Lovers Lane!

One of Nichols quotes fits in here just nicely

(1/V pg 80) "So it was just a story. It was made up".

(9/19 20).... "I said, how could you know an aeroplane could land in that field".. I don't remember him saying.."Oh i've landed one in it.... but he did say something like... "Well i have flown over and checked it out, like an aeroplane could land in that field"!

ANOTHER PITTING QUOTE

(1/V 4/32) "I've fucked the story up again"!

(1/V 9/20).... "You hear half the story and take the rest for granted".

This is clearly a Factitious diseased mind at work, but it gets even better!

Note .... If the alleged cocaine deal was just a "ploy", what would be the purpose of assessing whether an aircraft could land in this field?

Nichols lack of aviation knowledge unmasks him as a fraud. A pilot would glean little satisfaction out of flying over a site to assess suitability for landing, except in an emergency, if it were possible. The site would have to be physically inspected It could well be a bog for all you could tell from a closed cockpit.

Nichols does not describe a pilots attitude or view, merely a non aviators fabrication!

We clearly know that Nichols motive for murder, a £40k loan to Tate from the infamous "MULLOCK BROS" is a total fabrication, his finest example of Fact into Fiction to date.

The "Mullocks" of course are bungling undercover Irish speaking cops (Mullock Cops)!

We have to assume of course, that the Mullock cops have not loaned Tate £40k to purchase drugs with.

However, In the light of D.C Bird and D.S Stimpson and the content of the Mullock Cops taped phone calls with Steele, it becomes a debateable serious issue!

Nichols alleges an importation on 8.11.95 by Steele, turns out to be poor quality Tate has invested. Part of his investment is £40k of Mullock cops money. A refund is sought and Tate is re-imbursed. Tate although re-imbursed tells his backers Mullock Cops (M cops) Steele has not returned the £40k, so Tate will kill Steele on his knees in front of the M Cops!

This Nichols tells us, is all fed back to Steele via Sarah Saunders

Steele plots to murder "Tate et al" for this, and plans to lure them to a clandestine "drop zone" (d.z) under the guise of an importation of cocaine, Aircraft will be the mode of transport.

Nichols claims the bait is 5 Kilos of cocaine compared with Jaggers 30 kilos of cocaine.

This alleged cocaine deal, was the prosecutions first motive for murder, as Steele was to be ripped off with his share of the cocaine. It is now adopted as bait!

It has been my belief all along that this scam to lure Tate et al to death alley is pure fact! "Nichols Fiction"!

Nichols imports the impure cannabis, which is sold to Tate prior to the 8th Nov 95 Tate get re-imbursed but fails to return all cannabis supplied to him, which Nichols believes to be of good quality! See Nichols itemised bills for September and October Also TSB card re: booking P & O Ferries.

It is Nichols who now plots to kill "Tate et al". Notice the Mullock cops are not in the Range Rover! Nichols tells greedy Tate, Steele is to fly 5 kilos of cocaine into the country and he knows exactly where and when!

They're going to "kill the fucking pilot" ... On the evening of 5.12.95. Nichols travels to the Halfway House, calls Tate from the phone box and arranges to meet "Tate et al" just to show them the d z. on the evening of the 6.12.95.

The rest of course is History.

Following extract; covering a cocaine deal, an alleged ploy to entice "Tate et al' to their deaths, clearly show Nichols weakness of memory.

(4/10 14.5.96) Nichols alleged conversation with Steele on their way to the Halfway House on 6.12.95, Quote.... "I've gotta sort everything out with Pat. It's gone far enough, we're gonna have a talk about it, he said so we're gonna have another deal together. We've got a coke deal going down, we're all gonna earn plenty of money blah blah blah"!

....(pg 11).... "Im staying at the Halfway House to have a drink with Pat, and to make friends"!

This is a CRUCIAL statement from Nichols. He maintains vigorously throughout., he only hears of a falling out between Steele and Tate after the murders, which he claims comes via Saunders, see (4/8) (3/33 to 35) it is the "tense" in which Nichols speaks, indicates he is knowledgeable whilst Tate is alive!

(Committal 14.10.96 pg 18) Compare this topic commencing 5 lines up, with the above references

Nichols is crystal clear when he alleges to be told of a cocaine deal, whilst driving to the Halfway House on 6.12.95 It is also obvious much money is to be earned. There is no mention of a PLOY to murder.

(7/15 17.5.96) Nichols once again is crystal clear! Quote... "I couldn't understand why Jack wasn't going with them in the Range Rover to show 'em where an aeroplane would be landing with cocaine in the future"!

Once again in the above it is the "tense" in which Nichols speaks the all important.

(7/15) Nichols has clearly stated when he is told of this cocaine farce, but DC WINSTONE finds it necessary to ask him again!

We get two answers!

(7/15) Quote.. ."Um! In going down that they are like y'know making it up as it were" (to Halfway House)

D.C Winstone asks Yet again!

Quote "I don't know, I'm not sure he might of...It might have been said... I think so ..It's something that I really put out of my mind quite a lot. I don't think he's ever mentioned that story like to me before that day ...I'm pretty certain he hasn't

Notice Nichols still hasn't mentioned it's a PLOY!

(8/37 17 5.96) Once again Nichols is asked on the same day, during a later interview, the same question, but this time the question is put by Brown (8/36) which is an obvious "PROMPT".. "Did Micky Sleele ever say to you the reason or the story that he'd given the people in the Range Rover to go there"?

What Brown seeks, is mention of a "PLOY", So far Nichols is telling us a genuine cocaine deal is being hatched!

(8/37 17.5.96) Nichols now quotes... "Like i said I'm not sure if i heard the story before or after (murders) but i'm bit of both".

Nichols now begins to unmask himself

"they were showing them where an aeroplane was gonna land in a field"
"the thing from him was, that you kill the pilot"!!! (Who does he mean by "HIM" Tate)?
"Fuck him we'll have all their money"...("Him" does he mean Steele)?
"We'll have all the drugs away"!)
"5 kilos of cocaine"
"this is something Mick pulled out of his head"
"Something that appealed to Pat "cause he loved cocaine"! (Nichols here presumes and appears knowledgeable of Tate's lusts)!

Does not the fore mentioned quotes appear a little de'ja'vu similar to D.C Bird and Nichols plotting over_a telephone line to steal cash and drugs?

Or rather odd that Steele is setting himself up to be "ironed out".... Kill the pilot?

(9/19 20.5.96) It is now that Nicholls tells us exactly whos idea it is to bait "Tate et al" ....Quote.... "Originally it was for a deal that was in my mind and then i now know that it was they told them the deal was gonna take place there and they were He was showing them where an aeroplane was going to land in a field at the bottom of that lane"...

(9/20 20.5.96) Quote "the pilot would be having a large amount of cocaine and all they had to do was kill the pilot and have the cocaine... that_was the ploy"!

We now have a question asked by D.C Winstone, which I feel sure he wishes he'd never asked, and Nichols assumes it to be another PROMPT as his reply is bizarre!

(9/20 20.5.96 Quote.... "Did they say what was likely to happen to the aeroplane "they're on"? (Where does Winstone get "they" from)?

How many times does Nichols have to tell this half wit...... "Its a ploy" there is no aeroplane! BUT... THERE'S NO STOPPING NICHOLS!

Nichols reply Quote.... "Um! again can't remember.... you hear half the story the rest you take for granted ... I'm not sure if they were gonna make it look like... I can't remember... I had in my mind originally.... I thought that they were just gonna do the pilot... and then burn the plane.... probably with the pilot in it..... to make it look like some sort of accident... Ploy to get them there, all you got to do is kill the pilot! ... "See something I really, I'm thinking about it I've got a feeling that Mick was saying he was going to be the pilot"!

"I think he was saying that in his mind that they would kill him, take the drugs "AND THAT WAS THE REASON FOR KILLLING THEM"

.. "I think he set them up to believe"...

Once again very "de' ja' vu" (N apache 5 7.96 pg 18) "I thought I'd set em up to get 'em nicked".

Q. Did you in fact set "Tate et al" up to murder them? Notice Nichols pulls another (Motive out of his hat. This time because of what Steele ASSUMES Tate is planning to do himself, at Steeles own murder plot! "Phew"!

Nichols also introduces non return of drug refund money as another motive (3/36 17 5.96) Quote "Did you do 'em for their do over that money''?

Of course Nichols has told us no fewer than 4 times that Steele returns the cash to Tate. (Committal 14.10,96 pg 11) (3/31 14.5.96 pg 31 32) (4/48 14.5.96 p8) (Nichols statement 22.5.96 pg 10).

A classic slip of the tongue (9/22 20.5 96) Quote.. ."Pat was saying how much he hated "ME" (Nichols, how much he'd fucked him up with drug deals)!

We should remember here, Nichols claims Tate has been re-imbursed with his cash He has also ended up with 1/3 X 100 kilos free! And nicked £40k from the Mullocks. Yet he feels, according to Nichols, he's been "fucked up" with drug deals"!

According to Nichols saga Tate must have:-

33 kilos cannabis resin @ £2,200 per kilo = £72,000
Stolen from the Mullocks = £40,000
Total netted A Cool = £110,000

Q. Mr Nichols... Can you tell us, precisely what is it Mr Tate was griping about?

Nichols alleges a V.W Passat, once owned by him, is used is used during a triple murder. A vehicle prone to Police spot checks travels to a murder scene with two shotguns concealed inside a chippies bag sat on the rear seat, along with a set of false number plates, a coat and surgical gloves. After the murders leaves the vicinity, then drives back past the murder scene with the murder weapons still, on the back seat, presumably inside a chippies bag, with of course blood stained surgical gloves.
